1. Acceptance & parties

These Terms of Service and End User License Agreement (together, the "Terms") form a binding agreement between you and 李国庆 ("we," "us") regarding your use of the SteadyHeart (稳心) app (bundle identifier: info.steadyheart.app) and its related website (https://steadyheart.dalizixun.cn) and services. By downloading, installing, accessing, or using SteadyHeart, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the app.

These Terms should be read together with our Privacy Policy and Medical Disclaimer, which form an integral part of them. If you use the app on behalf of someone else (for example, as a guardian or authorized caregiver), you represent that you have the necessary authorization (see Section 5).

2. License grant (EULA)

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use SteadyHeart on devices you own or control, for personal, non-commercial purposes. All rights not expressly granted in these Terms are reserved by us.

2.1 Apple-specific terms

If you download the app from the Apple App Store, the following terms apply:

  • This license is concluded solely between you and 李国庆, and not with Apple Inc. ("Apple"); we, and not Apple, are responsible for the app and its content.
  • Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the app.
  • To the extent permitted by applicable law, Apple provides no warranty for the app; any claims relating to the app are handled by us, and not Apple, in accordance with these Terms and applicable law, except as set out in the third-party-beneficiary clause below.
  • You agree to comply with the usage rules and applicable agreements of the relevant app store, and you represent that you are not located in an embargoed country subject to U.S. export controls and are not on any prohibited or restricted list.
  • Third-party beneficiary: you acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

2.2 Other app stores

If you obtain the app through Google Play or another distribution channel, you must also comply with the terms of use and rules applicable to that channel.

3. Product positioning & medical statement

SteadyHeart is a health-management and record-keeping tool, not a medical device. The app does not provide medical diagnosis, treatment advice, or prescriptions, and does not replace in-person consultation or professional medical advice from a licensed physician.

Deterministic alerts in the app are reminders generated from the data you enter and fixed thresholds/rules, intended to prompt you to seek in-person professional care promptly. They are not medical decisions and do not constitute any medical judgment. For any decision about your health, consult a licensed physician or other qualified medical professional. In an emergency or if you see abnormal readings, seek in-person care immediately or call emergency services. See the Medical Disclaimer for details.

4. Acceptable use & user obligations

When using the app, you agree to the following obligations:

  • Accurate data: ensure the health and personal information you enter is truthful, accurate, and complete, and understand that record quality affects the reference value of reminders and reports;
  • Lawful use: comply with applicable laws and regulations and not use the app for any unlawful or unauthorized purpose;
  • Credential security: keep your account credentials and device unlock method secure, and take responsibility for activity conducted through your account;
  • Caregiver authorization: if you manage data on behalf of someone else, ensure you have obtained the appropriate guardianship or proxy authorization (see Section 5);
  • No interference or damage: do not reverse engineer, crack, interfere with, or attempt to gain unauthorized access to the app and its systems, upload malicious code, or engage in conduct that harms the security of the service or the rights of others.

5. Accounts, caregiver proxy & termination

Accounts: some features require registering an account. You are responsible for activity under your account and should keep necessary information up to date.

Caregiver proxy: the app supports guardians managing data on behalf of minors, and family members managing an adult patient's health data after confirming proxy authorization and obtaining the consent of the patient (or their legal representative). By using proxy features, you represent and warrant that you have obtained the appropriate authorization.

Termination: you may stop using the app at any time and may request deletion of your account and data via the Account & Data Deletion page. If you materially breach these Terms or engage in unlawful conduct or conduct that harms our or others' rights, we may suspend or terminate your use of the app as necessary. Provisions that by their nature should survive termination (such as limitation of liability, intellectual property, and governing law) remain in effect after termination.

6. Disclaimer of warranties

To the maximum extent permitted by applicable law, the app is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, or uninterrupted or error-free operation. We do not warrant that the app will always be available, will meet all your requirements, or that reminders and reports will be entirely accurate. You understand and agree that your use of the app is at your own risk.

7. Limitation of liability

To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of or inability to use the app. Because the app does not provide medical diagnosis, treatment advice, or prescriptions, your judgments and decisions on medical and health matters should follow the advice of a licensed physician or other qualified medical professional, and we are not liable for consequences arising from your reliance on the app's content in place of professional medical advice.

Nothing in this section excludes or limits liability that cannot be excluded or limited under applicable law (such as for personal injury or in cases of intent or gross negligence).

8. Intellectual property

Intellectual property rights in the app and its related software, interfaces, trademarks, logos, text, graphics, and other content belong to us or the respective rights holders and are protected by law. All rights not expressly granted to you in these Terms are reserved. You may not copy, modify, distribute, sell, rent, or otherwise exploit such content without prior written permission. The personal health data you enter in the app remains yours, and we process it only for the purpose of providing services to you, in accordance with the Privacy Policy.

9. Governing law & dispute resolution

The governing law and the jurisdiction/dispute-resolution mechanism applicable to the formation, validity, interpretation, performance, and dispute resolution of these Terms will be specified here.

Before pursuing formal dispute resolution, we encourage you to contact us first at steadyheart@keephealthy.work, and we will seek to resolve the matter in good faith.

10. Changes to these terms & notice

We may revise these Terms from time to time. When we make material changes, we will notify you through in-app notices, website announcements, or other appropriate means. Changes take effect on the effective date specified in the announcement or notice. If you continue to use the app after the changes take effect, you are deemed to accept the revised Terms; if you do not agree, you should stop using the app and may request deletion of your account and data.
